Terms of use for information, software and documentation of Ziehl-Abegg AG
1. USAGE PERMISSION
The information, software and documentation provided by Ziehl-Abegg can be freely used for private as well as commercial purposes. Ziehl-Abegg grants Users a non-exclusive and non-transferable right to use the information, software and documentation free of charge without time restriction, limited to the extent of the purpose intended by Ziehl-Abegg in making same available.
2. DESCRIPTION OF ADDITIONAL RIGHTS AND LIMITATIONS
Information, software and documentation may not be distributed by the User to any third party at any time nor may it be rented or in any other way made available. Unless such is allowed by mandatory law, the User shall not modify the software or documentation nor shall they disassemble, reverse engineer or decompile the software or separate any part thereof. The commercial utilization or propagation of information, software and documentation - in any form whatsoever - requires a written consent by Ziehl-Abegg. The User may make one backup copy of the software where necessary to secure further use in accordance with these Terms of Use.
3. COPYRIGHT
The ownership and copyright of the information, software and documentation (including, but not limited to any kind of pictures, photographs, animations, video, music, text, and "applets", which are included in the software), the printed accompanying materials and all copies of the software product lie with Ziehl-Abegg.
The information, software and documentation are protected by copyright laws as well as international copyright treaties as well as other laws and conventions related to intellectual property. The User shall observe such laws and in particular shall not modify, conceal or remove any alphanumeric code, marks or copyright notices neither from the information nor from the software or documentation, or any copies thereof. §§ 69a et seq. of the German Copyright Law shall remain unaffected.
Except for the rights of use and other rights expressly granted herein, no other rights are granted to the User nor shall any obligation be implied requiring the grant of further rights. Any and all patent rights and licenses are expressly excluded.
4. PRODUCT SUPPORT
Users have no claim to product support by Ziehl-Abegg. Product support will be offered via email and telephone.
5. UPDATING
Ziehl-Abegg is not obliged to make available updates for the User. However, all updates provided by Ziehl-Abegg are covered by this license agreement.
6. LIABILITY FOR DEFECTS OF TITLE OR QUALITY / OTHER LIABILITY
Any liability for defects as to the quality or title of the information, software and documentation especially in relation to the correctness or absence of defects or the absence of claims or third party rights or in relation to completeness and/or fitness for purpose are excluded except for cases involving wilful misconduct or fraud.
Any further liability of Ziehl-Abegg is excluded unless required by law, e.g. under the Act on Product Liability or in cases of wilful misconduct, gross negligence, personal injury or death, failure to meet guaranteed characteristics, fraudulent concealment of a defect or in case of breach of fundamental contractual obligations. Damages in the case of breach of fundamental contractual obligations are limited to the contract-typical, foreseeable damage if there is no wilful misconduct or gross negligence.
As far as legally allowed, in no event shall Ziehl-Abegg be liable for any damages whatsoever, including without limitation, damages for loss of profits, business interruption or loss of information.
